Terms of Service

1. Acceptance of Terms

By accessing or using Starworks, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service.

2. Service Description

Starworks provides:

• Automated review request campaigns via email and SMS
• AI-powered review response generation
• Review monitoring across multiple platforms (Google, Facebook, etc.)
• An optional direct connection to your Google Business Profile to sync reviews, publish replies you approve, and manage your listing details
• Analytics and reporting on your online reputation
• Customer feedback management tools

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payment

Starworks offers several subscription plans:

• Essentials Plan: $49 AUD/month, or $490 AUD/year (equivalent to ~$40/month)
• Professional Plan: $99 AUD/month, or $990 AUD/year (equivalent to ~$82/month)
• Growth Plan: $135 AUD/month, or $1,350 AUD/year (equivalent to ~$112/month)
• Custom/Enterprise: Custom pricing based on requirements

All payments are processed securely through Stripe. Monthly subscriptions auto-renew unless canceled before the billing date. Annual subscriptions offer approximately a 17% discount over the equivalent monthly rate.

5. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Your subscription will remain active until the end of your current billing period. Refunds are provided at our discretion for unused portions of annual subscriptions.

6. Acceptable Use

You agree NOT to:

• Send spam or unsolicited messages to customers
• Violate platform policies (Google, Facebook, etc.)
• Upload or transmit malware or malicious code
• Impersonate another person or business
• Solicit fake or fraudulent reviews
• Use the service for any illegal purpose

7. Data Ownership

You retain ownership of all customer data and content you upload to Starworks. We claim no intellectual property rights over your data. Upon account deletion, your data will be permanently removed within 30 days.

8. Connected Platforms and Google Business Profile

Starworks can connect to third-party platforms on your instruction, including Google Business Profile, review sites, and the customer systems listed in your settings. Connecting is optional, you choose which platforms to connect, and you can disconnect any of them at any time.

When you connect a Google Business Profile, you confirm that:

• You own that business profile, or you are authorised by its owner to manage it and to grant us access on their behalf.
• You authorise us to read your listing information and reviews, to publish review replies you approve, and to update listing details at your direction.
• Your own use of the profile complies with Google’s terms and policies, including its prohibited and restricted content rules.

For our part:

• We act only on your instruction. We will not post a reply, edit your listing, or take any other action on your profile unless you have asked us to, either directly or by switching on a setting that does it for you.
• We will not enable any automated action on your profile without your prior, specific, and express consent, and you can switch that consent off at any time.
• If we make a change to your Google account itself, such as adding or removing a manager, we will notify you within 48 hours.
• You can disconnect from your settings, or revoke our access directly in your Google account. Either one stops all further access immediately.

Our access to Google’s APIs is granted by Google and is subject to the Business Profile API terms and policies and the Google API Services User Data Policy. Google may change, limit, or withdraw that access at any time, and any connected platform may change or retire its API. If that happens we will tell you and offer an alternative where one exists, but we are not liable for a connected feature becoming unavailable for reasons outside our control. Starworks is an independent product and is not affiliated with, endorsed by, or sponsored by Google.

What we access from a connected platform, how we use it, how long we keep it, and how to have it deleted are set out in our Privacy Policy.

9. Service Availability

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for any downtime or service interruptions beyond our control.

10. Limitation of Liability

Starworks is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the past 12 months.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of our service at any time with reasonable notice. We may also update these Terms of Service periodically. Continued use of the service constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Service are governed by the laws of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria.
